Assalamu-Alaikum

Muftisaab, i am writing to you as i am not sure and 2 diff jamiats have given me 2 diff rulings. I need 2 know what yours is. My husband and i are seperated. We had an argument on the phone, bare in mind that i am bipolar and was heavily medicated when this incident took place. I dont remember much of it. 2 weeks ago, i phoned my husband after taking meds, saying we should end the marriage, he said we will work on it, after i ”persisted”, i am not aware of this, he asked if you want” it”, take ”it” and i asked are you giving me final he replied yes, bare in mind that he’s given me 2 talaaq before. Kzn says you want it, take even till him saying yes is exercising option, while jhb jamiat says replying yes sounds like but they’re not sure, is affirmation that he is giving it. At first jhb jamiat said IT has many meanings, now they are investigating it but husband said ”it” was not meant in the respect of take your talaaq. Where does this leave us?

It all depends on what your husband meant by 'it' - if he meant Talaaq which is most likely for the discussion rotated around Talaaq, then Talaaq has taken place.
