Man Making Conditions Indicating Divorce Before Marriage

Question ID: 15022

Aslam Alaykum

Please could you give a fatwa on the following:

A man says one of the following 3 statements to his wife before marriage, but cant remember which one:
‘if you do a certain act then I will divorce you’, OR ‘i am going to divorce you when we get married if you do a certain act’, OR ‘You are divorced after the wedding if you do a certain act’.

After the marriage (a few years)  the man was confused which statement he had said, so in order to recapture, remember what he might have said before  the marriage, he verbally has been trying to repeat these words, so he can remember what he had said. The words he has been repeating to remember the past are ‘ I will divorce you, I am going to divorce you and you are divorced’.

1) Since these present verbal repititons were acts of recapturing the past in an endeavour to remember what the man had actually said, does these repetitions affect his nikkah?

2) Now if due to too much recalling, recapturing, and doubts, maybe waswasa, the man at times finds himself saying these words or just happens to say these because his tongue had gotten used to saying these. Does that affect the Nikaah?

He hasn’t said any of the above to his wife or to anyone else.
