Oasis crescent equity investment

My parents have an oasis crescent equity investment. My father has used a very small portion of the earnings as part of his Hajj expenses.

I have recently heard that it is not a permissible investment and that they should dissolve the investment. The original money invested must be deducted and the balance on the fund must be given out with no intention of reward.
If any part of the earnings was used we must make an effort to collect the money and give it away as well. The reson for this is because of the difference of opinion of the Ulema and no one knows who the Aalims are that sit on the advisory boards. (Jamiat-ul-Ulama in Johannesburg have given me this answer.)

Please advise me if this is the correct manner in which we should proceed and do you know who the ulama on the advisory boards are? Or how we can go about finding this out?
