Permissibility of ones adoptive father not to include one in his will

Question ID: 24533

i was adopted when i was 5 years old by my uncle (biological father’s younger brother). My uncle later married again and has a daughter. He now permanently lives with his second wife and daughter and does not fulfil any duties towards his first wife. in fact they have not spoken for about a year now. i want to know in this case are they still islamically husband and wife or not? and is it islamically correct that he has not included me in his will? if so do i have a right to ask him for a part of his inheritance (i am now happily married).

As long as no divorce was issued they are still married.
He is not obliged to include you in his will you can request from him and he can include you in the 1/3 optional part.
