community of property

My Parents were married in community of property. During there marriage my father built their house and the property was registered in his name. The property was in the process of being sold when my mother passed away.
1. does the proceeds of the sale which is now done, goes to my father or
2. does 50% of this proceeds belong to my mother.
the reason for this question is that we would like to ensure we are handling my mothers affairs in accordance with shariah. By them being married in COP means that my mother would had a legal right to 50% but this would not have mattered if she were living.

The Hajj will be valid. Let some reasonable person intervene and settle the differences of all. By invitation, with diplomacy let sanity prevail. Allah will reward.
