Joining jamaat late

Assalam o alaikum,

Respected Mufti Saheb, I want some confusion to be resolved. Suppose I came to the masjid and saw that the imam is in the fourth rakat and by the time I make wudhu and join him he makes sajdah and sits in the attahiyat. So my question is will I join the jamat and sit in the attahiyat and should I read attahiyat or leave and just keep quiet and get up after salam. Or should I let the imam make the namaz and I shift at the side or back saff and read my salah alone as I know that I will not the jamat as already 4 rakats have been read.

Q2. Secondly if I have to join the imam in the attahiyat though I did not get even 1 rakat of namaz with jamat will I make niyat of behind the imam and sit in the attahiyat or I will make niyat that I am making my 4 rikat namaz of so and so time and will not mention the word “behind imam” and then sit for attahiyat as I will have to read all the four rakat individually and imam will not guide me in this case. What do I do.

Please avoid confusion as soon as possible.

Private answer

1) Join the Imaam, read 'Attahiyaat..' and when the Imaam renders the Salaams you get up. You have joined the Jamaat.

2) No need to say 'behind Imaam' - just make Niyaat and join the Imaam.
