Muhtaram Hazrat Mufti Afzal Saheb, As salaamu ‘alaykum wa rahmatullahi wa barakatuhu, I make du’a that Mufti Saheb is well. May Allah Ta’ala keep Mufti Saheb with Aafiyah and grant Mufti Saheb the best of Dunya and Aakhirah, ameen. I require Mufti Saheb’s guidance on the following: If a South African has his qurbani made overseas, e.g. India, what is the ruling of his qurbani in the following scenarios: 1. If the 10th Zul Hijjah falls on different days in both countries and the animal was slaughtered in India before the eid of South Africa? 2. If the 10th Zul Hijjah in India falls after the 12th Zul Hijjah of South Africa? 3. If after witnessing the 10th Zul Hijjah, a South African instructs a friend of his in India to perform qurbani on his behalf, who has not yet witnessed the 10th Zul Hijjah? The above questions arise based on the following understanding: 1. Qurbani cannot be performed before the wujoob (witnessing tuloo’ fajr of the 10th zul hijjah) comes upon an individual. 2. The days of qurbani are three (10th, 11th &12th). If the 10th Zul Hijjah in India falls after the 12th Zul Hijjah of South Africa, it may necessitate that the South African is having more than three days for qurbani, as the wujoob is upon him and he is allowed three days only. 3. The principle explained by the fuqahaa, المعتبر في ذلك مكان الأضحية , contextually seems to refer to situations when the day of eid are on the same day (the example of the مصر and قرى), or else it will lead to the permissibility of qurbani before the wujoob comes upon an individual, which is against the principle of the fuqahaa. 4. The time of slaughter begins after tuloo’ fajr of 10th Zul hijjah. The animal is the object of slaughter and the place of the animal (مكان الأضحية) considered with regards to the time of slaughter. If after witnessing the 10th Zul Hijjah, a South African instructs a friend of his in India to perform qurbani on his behalf, who has not yet witnessed the 10th Zul Hijjah, the qurbani may not be accepted as the animal was slaughtered before the 10th Zul Hijjah. Please advise on the following, I like to buy a portion of cow with my other community people who all are adult, I can do that please let me know, it very important for us to know. We live in Ottawa, Canada. Here it not possible to buy a cow for myself.Thank you

You may do so but sharing of meat then has to be done by weight.

As salaamu Alaikum I trust that you are welll and had a good Eid. I have a query regarding the distribution of qurbaani meat. Whilst i understand that the sunnah method is to divide the meat into 3 parts and give to family & friends, the poor & myself; I am in the situation whereby the needs of the poor in the surrounding rural & informal communities outweigh the needs of friends, family & myself. Is it permissable to give all the meat to the poor?

Answer

It is not Sunnat but Mustahab to divide into 3 parts.

All meat can be given away to the poor.

Is it necessary for the person slaughtering on behalf of someone (wakeel) to take the names of the person/shareholders (muwakkil) on behalf of whom he is slaughtering?

Answer

Can make blanket intention - like slaughtering now for Ahmed's family.

Asalamwalaykum If my husband and I are working and we do not combine our salaries, Do I as the wife buy my own sheep an slaughter on my own behalf? or can my husband buy 1 sheep an slaughter on mines and his behalf together? (If so do I give half money for the sheep) ? Aswell, Do I have to be there to slaughter the sheep myself or can my husband slaughter the sheep on my behalf?

Answer

If you are having at the time of Qurbaani so much of wealth that you have to pay Zakaat then 1 share or 1 goat/sheep becomes compulsory for you to slaughter your husband can do it on your behalf with your permission. You do not have to be present when it is slaughtered.

Asalaamualaikum What is the difference between Qurbani and Dam-e-shukr? shukran

Answer

Damm-e-Shukr is the sacrifice of a goat in the boundaries of the Haraam in order to come out of Ihraam. Qurbani is the normal sacrifice done by a mature Muslim who is in possession of Zakaatable wealth during the days of sacrifice. Can be done anywhere in the world.

Salaams Mufti Saab, I wanted to give a sheep as Sadaqa to the Darul Ulum or an orphanage. Does the sheep have to fulfill the requirements of a Quarbani Animal namely 1 year old, tail uncut ect thanks for the wounderful site, may Allah reward you and all that assist you in your nobile effort.

No - but if Sadaqah is of Wajib in nature then all (D.U) must be informed that only the poor can eat.
