Assalaamualaikum. MY question is wether or not it would be allowed for one to take a job as a assessor? In this field one is emplyed by an insurance company and then required to go out to inspect damage to vehicles and give a report. Judging from the report given it will then be decided wether or not the vehicle can be repaired or written off resulting in payments made to the insured. Shukran.

Dear Mufti. I refer to your answer to question, Question #8810 – 28/01/2013.
I have a similar problem but more intense. I spoke to Mufti Menk and he advised me that when coming to children the father must be just and equal in his life time and not distribute unequally causing Hatred, Jealousy and fighting amongst the children. I was advised that this is a major sin.
Also I have read several other articles and spoke to many other mufti's and Aalim's in and around Pretoria and Johannesburg on this issue and all agree that it is a major sin by the father. I also spoke to Molana Afiki.
They have however advised that he can do whatever he wants with his wealth when it comes to giving third parties.
Kindly please advise.

A person whilst he is alive can give whomsoever his wealth provided he is sane, not under duress and not in 'Marzal Maut' - such a sickness that is fatal.

assalamualaikum
Q: can someone in needs of a house, without means to pay the house cash, turns to a bank, which means interest, to conclude the deal, although that person can hire a house without great difficulty. In my country some Oulemas say that for a first time , one can turn to a bank to buy a house. For an ignorant(in deeny matters) like me, this argument sounds strange as we have always learned to avoid interest line the plague. For Allah's sake please clarify this matter.

One should do some calculating. If over 10 years the amount paid in rental will be the same as purchase price of a current house then take a back loan which has to be fixed and the installments fixed and without increasing interest and with if possible option of settlement. However better to stay away from interest.

Salaam Mufti Elias,
Can you advise what the Shariah ruling is on child maintenance payments, mienfadliek. The agreement between myself and the father of our 2 year old boy (we were married by Islamic rights only and not in court) is that he will pay R1000 per month which he has been doing until October last year where he only paid half, then half in November, nothing in December and again nothing in January. This brings the total owed by him to R3000 so far.
He has unlimited access to his son for visits and picks him up once a week on a Sunday (when he can make it) to spend the day with him and his family.
What manner of recourse do I have with regards to his short and non-payments as currently I am footing the entire bill for our child.

Then when he does not fulfill his agreement - use legal action.

Please advise the Shariah viewpoint on tax evasion. Often I have heard muslims saying that our government is making zulm on us so we are permitted to evade tax.
I am of the view that zulm should not be limited to only when it affects our pocket, I dont think there is any country on earth where Muslims are literally free to practise Islam. In my opinion our government is not making zulm on us in so far as we practise our deen.
Please advise.

One is not paying taxes, the other is avoiding taxes.
A good accountant will draw your books so that you within the legal framework of the country, pay minimal taxes.
Then when paying the tax itself you can use interest. But pay.

I am considering opening a used car business/dealership, i would like to know if its permissible to sell vehicles on higher purchase using bank finance considering the fact that not all customers can afford to pay cash for a vehicle they want and/or not all customers are willing to use the islamic finance options/packages that certain banks like Absa & Wesbank are offering to finance their vehicle because they feel they save more money in the long run when the lending rate & term are both not fixed.

Slmz Mufti...if a pension is paid out to an employee at the time of retirement and according to statutory law you can only cash in 1/3 of it, while the remaining 2/3 has it be re-invested in a similar fund (money never coming into your hands), what are the zakaat implications on the
a) 1/3 cash pay out
b) not he remaining portion of the reinvested cash
c) on the month income derived from the re-invested cash.

a) If you are a Zakaat payee then pay Zakaat once off on it - otherwise if it exceeds the Nisaab and is then with you for the next Islaamic lunar, then you will pay Zakaat thereof.
b) No Zakaat on the remaining
c) If invested in Halaal area then Zakaat liable.

Assalaamu alaikum Dear Mufti,
My granny passed away in Oct 2007.In 2000 she asked one of her daughters to take her jewellery(whatever she owned at the time) to India on her next trip, to have earrings made and distributed to the "children" in the family, meaning two grand children(specified) and to the rest of the great grandchildren in the family. (The daughter and her husband being the only witnesses to this request). The daughter never ended up travelling to India & could not fullfill this wish (making of earings) but thought that instead of earrings it might be better to sell it all off, and buy kruger coins, which she did in 2006. In 2012, the daughter split up the kruger coins equally and wants to distribute it to all the great grand children equally according to her mothers' wishes. Questions:
1. is this permissible & what are the implications for my deceased granny?
2. If it can be distributed as granny requested, should it be to those great grand children born before Oct 2007 only?
3. I presume zakaat is payable on it, if yes, how should that be calculated,current value, value at the time of sale, or value at the time request was made?
4. At the time of her death, her husband, son, and three daughters were left. (Husband passed away in 2011). If her belongings have to be divided up how would that take place and,
5. How should the husbands share be divided (since he also passed away).
6.Is it permissible for the daughter to earn something based on her effort (investment etc) even though she has not requested it?
7. kindly advise what all the different mazhaahib have to say on this matter for education purposes.

Salaam mufti,hope u well. We r currently in debt and r trying to pay it off. Iv read a hadith something to the effect that the sahaba never ate meat if they were in debt-which means that they were never extravagant when in debt. So we quite strict on ourselves in spending money,but here and there we give out charity when we can. The other day °̩ read a msg broadcasted by crescent lifetysle,taken from Tirmidhi that an ignorant generous man is closer to اَللَّه سُبْحَانَهُ وَتَعَالَى than a worshipping miserly man.....and this is bothering me! Am °̩ being miserly in curbing myself when spending money because °̩ want to pay off these debts?

I am settling debts of my late father as an only son. and as an executor of his estate which has no assets except the house in which my Mother lives. Alhamdulillah I have concluded all, however, when trying to complete the transfer of the house into my Mum's name it came to my attention that a certain Muslim had issued an order as a collateral for a loan to my late father. After months we managed to locate the daughter of this person who has also become late. The amount owed was small and I had no problems to settle. The daughter insists on receiving interest for the period (10 years) and much as i tried to convince her that it is haraam she insists. Can i pay the capital amount through normal funds and pay the interest portion with interest ( i have a savings a/c which is interest bearing and which i deduct and give away without fail annually).
I have to pay to allow for the house to be transferred to my Mother. I am also able to pay the entire amount owed including the interest demanded through my normal funds as Alhamdulillah, I do have the means. Pkease advise urgently.

Pay the interest with interest.
You can also use interest for the tranfer duties.

Some of these shares are in banks. What I would like to know is the dividends from These shares permissible for me. I would also like to know if I should sell these shares immediately and if I do sell them will the money be permissible for me to keep or what should I do with it? JazakAllah

Distribute the dividends to some needy Muslim, sell the shares and you may use the money.
