asslamu alaikum, pls let me know that if my son age of 10 /15 perform umra with me,is hajj will be obligatory for my son ? a moulana said to me when you took your son for umra , he saw the qaba , thatswhey, omra is obligatory for your son if your son fail to perform hajj father will be responsible.

Hajj becomes obligatory when the person has sufficient funds to go. Not upon performance of Umrah.

is this answer correct or was it an error as i thought the ihram must be on prior to landing in jeddah as you pass a miqaat whilst in air ?

You cross the Miqaat but re-cross and then go to the airport which is outside the Miqaat. The Miqaat is on the floor NOT on the air.

As salamu alaikum wa rahmatullahi wa barakatu - mufti saab this is my second request on clarification of my concern Please advise why are people so eager to go for Umrah rather then go for Haj which is fardh. is this logic of doing umrah being cheaper an excuse acceptable??? or other logic of Haj seekh ke karna chaiye thats why umrah is like a rehearsal, or the other thing that Allah ke ghar ku dekhna ka mauka milta hai, aur inshallah haj ki niyat ki hai haj bhi karenge. please advise me with a clear understanding as per our shariah what is right. As of now Umrah is become a fashion statement and i feel Haj ki ahmeeyat kam ho rahi hai.

It is permissible to go for Umrah whilst one has not performed Hajj. Reasons may vary as you speculate and it is unfortunately becoming a fashion.

Assalamualaykum Mufti
I am accredited to go for hajj this year Alhamdulillah, I intend going with some frail and weak elders in my family, so I will be performing Hajj and being a Khaadim. My question Mufti sab is that I wish to get a package that moves to Azizia on the 4 Dhul Hijjah to make it easier for them(they cannot do much walking and need the toilet often), but it comes at a R 30 000 price difference compared to moving on the 1st Dhul Hijjah. I fear that I might pay for one type of package only to be given some poor excuse and be moved to Azizia on the 1st. In Mufti's experience with Hajj and other operators, what is the possibility of the above scenario happening? I want to get them to spend as much time in the Haram, as this opportunity does not come often, but I fear being cheated by an operator

Better to move on the 1st of Zil Hajj.
The crowds in Makkah increase and movement is greatly restricted especially for the elderly.

This is sub-conscious coming to the fore. At the rate things are going, that could be the cost in future. Go now if possible.

I have the opportunity to go on Umrah. I am a muslim but not practising. I am interested in Islam but do not practise. Would it be wrong of me to go on Umrah because I am not practising? I am hoping to learn more about Islam whilst I am there and hope this guides me down a path where I do start to practise and pray. Please advise?

You can go for Umrah. Join those that are practicing Islaam. Be amongst the pious and righteous. Become regular in Salaat with Jamaat in Masjid. Avoid bad company.

Salaams. I have heard that one should not go for Haj if in debt. What are the guidlines in going for Haj when ones home, and for e.g. vehicle, is not fully paid up as yet, but one has the means for other expenses and lives comfortably? Shukran.

In our age (2013) and our country (S.A.) with the on-going Hajj mess-up, if you are in debt and accredited and in debt as stated, then make arrangements for debt payment in your absence and go for Hajj.

Please assist me in making a discession, I applied to go for hajj last year 2012 with my wife and mother but I was not accredited by SAHUC. I assume that my apllication is still valid.
Last week I found out that my wife is to become a mother. If I estimate, 9 months is around Zil-Qaida.
My question is since you have alot of expierence in this field, should I go forward in planning this year for hajj or should I delay it to 1436.

Due to the Hajj debacle and gross chaos in the quota system, there is a back-log of 15,000 applicants pending.
Thus if you are accredited, proceed making adequate arrangements for your wife. Then apply again as a 'Mahraam' for you and your wife.

I am very much confussed with all the conflicting and contradictions over people going for UMRAH before performing HAJ and fatwahs given by some maulanas specially in India as "they have a NIYAAT of performing HAJ so its alright to go for Umrah". What is the actual ruling as per our Hadith and Shariah over UMRAH.
Also mufti sab if a lady is a widow and her son is not of sound mental health then can she go with her daughter and SON IN LAW is he accepted as a mehram for performing Umrah/Haj????

- The Son-in-Law is a Mahraam for the mother-in-law
- By performing Umrah, Hajj does not become Fardh in this age.

Sk of hatazari madrasha said father should not take of his child to omra performance, because if he see the Kaba, Haj will be faraz for him, if he could not perfom haj father will be responsible,if he has money he should perform two haj, one for financial ability and other for child age omra. This is not a correct ruling. The child can go for Umrah/see the Ka'bah - Hajj does not become Fardh upon the child.

We got into state of Ihram with intention to perform Umra before reaching the Meeqat. However, upon arrival in Jeddah we were not cleared by immigration due to a technicality on our visas. We were kept atJeddah airport and returned back home by the next available flight. What is the position regarding the Termination of Ihram. Do we have to cut our hair and is Dham wajib on us?

Give dhamm (goat) as penalty - you will be out of Ihraam. This sacrifice has to be done within the precincts (boundaries) of the Haram of Makkah.

Permissible if you have a suitable, reliable, co-lateral in the event of non-payment. This however will be Makrooh due to the interest factor and the mere fact that it is not Wajib to go for Umrah. Rather take a interest free loan.

If a person is going for HAJJ and there he will sacrifice an animal after Hajj (which is a part of Hajj), my question whether he will have to sacrifice an animal at his home country (compulsory) which can be done by his family members at his home country. Please clarify, Jakallah.

If the person performing Hajj is not a traveller - Muqeem and is a Sahib-e-Maal - one upon whom Zakaat is Wajib then that person has to make another Qurbaani - he can deputize it to be done anywhere else in the world.

My Father-in-Law & Mother-in-Law had performed the Hajj this year. Insaallah their Hajj & Niyaat will be accepted to the Almighty Allah. Meanwhile, my father & mother both are alive & physically fit. They had not yet performed Hajj yet. My Mother-in-Law & Father-in-Law informed us that they performed Umrah Hajj on behalf of my parents.
My question is, Is it valid & accepted in Islam ?

If it was their Fardh Hajj then it cannot and will not be transferred to someone else.
If Nafl then the Sawab (reward) can be transferred to someone else in this case your parents.
However this does not mean that your parents do not have to perform their own Fardh Hajj.

without Wudu. Can he still have sexual relations with his wife and every other relationship with his wife?

I just wanted to find out.
Moulana A.R Khan said that if you go for Umrah , Hajj is not compulsary after that.
I know that if you go for Umrah before Hajj , Hajj becomes compulsary.
He said that with the current price of Hajj being so high the poor won't be able to afford it. He said that they can go for Umrah and Hajj does not become compulsary.
Please advice as 1 of my friends can not afford to go for Hajj but can save enough to go for Umrah.

What has been said is valid. Especially in these days the kingdom authorities clear all out before Hajj so that they are able to administer properly. Moreover, due to the tedious process of getting accreditation via Sahuc one is able to perform Umrah easily not Hajj.

ASalaam wa alaykum mufti saab im on haj, my wife is expecting and was fatigued by the journey to arafaath, we both follow imam abu hanifa ,We left early from musdallifah at the time of thuhajud towards mina,to avoid the heat and to move slowly given my wife condition, we made fajr in mina and then stoned big shaytaan, someone advised that i didnt forfill the wuqoof of musdallifah i.e to perform fajr in musdalifah and i should give dum,please advise if dum is due and if so the value for each person?
