As Salaamu Alaikum Mufti Saheb, I work for an advertising company, which creates adverts for its various clients. My job as a designer requires me to prepare adverts, which at times involves editing pictures of people used in these adverts. My question relates to the permissibility of the editing of such pictures, and secondly, whether it would be permissible for me to prepare adverts of people without modifying such pictures.

Answer

Avoid editing or modifying pictures of animate objects. It is not permissible.

Assalaamualaikum. I have a sweet bussiness and a big part of my bussiness is supplying hawkers. Their is a certain product(Mielie Pop) which is in demand and neither myself or my competitor are able to get a good enough supply of the product in order to meet the demand. Some of the hawkers only buy this item and nothing else and it leaves me short at times when trying to keep supply for my regular customers. Q1. My competitor has a policy that if customers don't buy anything else from his shop besides this item he charges them a higher price,can this be done according to shariah as it forces people to purchase other items as well? Q2. Would I be wrong if I turned customers away who only buy this item in order to keep it for my regular customers who buy other things from me as well? Q3. Selling products like ntsu/snuff is this permissible? Jazakallah.

Answer

1) An item can be sold at any price provided it is not a dire necessity. 2) You are entitled to sell an item to whomsoever you will and visa versa. 2) Snuff permissible - I do not know what is ntsu??

Assalaamu Alaiykum, Dear respected Mufti Saheb, We have hired the services of an aalim but we require you to assist us in making the correct decision. We have found the aalim to be untrustworthy, as many times he lies to us with a straight face. I feel that as the aalim is unloyal to us in the sense that we can not even tell if he is telling us the truth or not we should relieve him of his duties. He also has a history of borrowing money from people and not paying them back. On these grounds is it correct to relieve such an imaam of his duties? Should such a person be allowed to lead people in Salaah when we have clear and sound proof for this? Jazakallah,

salaam mufti. If you enter into an agreement with a landlord,where they are well aware of the occupants and grant you the flat based on full knowledge of the inhibitants, and issue a split bill for water consumption (ie. 4 tenants and the bill is split evenly) and suddenly the final biill is doubled(because the occupants has moved out) with the reason "due to number of occupants" in other words the landlord has doubled the bill and his reason is the number of occupants in the flat. Is this the right of the landlord or is this a breach of contract,since this was never stipulated initially and the tenant is now surprised by this unforseen expense. Is the landlord justified in demanding this payment or should he stick to the orignal method of payment since No prior arrangements were made for a diffrent method of payment. He is now demanding a huge amount of money for the water bill and the tenant feels this is wrong on his part to do so (he has doubled the bill) shukran salaamualaykum

Answer

It is breach of contract. The landlord must draw up a new contract which the tenants can either accept or reject.

Assalaamualaikum. Would like to know. Person A sold his bussiness to person B because of old age and traveling from home everyday to his suppliers to buy goods and then to his shop and felt it was now too much. He also had ideas of doing other things once the bussiness was sold in order to earn an income but 8 months later after selling the bussiness he decides to open the same type of bussiness that he sold going through exactly the same as before and selling a lot of the same items. He also opens his new bussiness a very short distance from his previous bussiness. When asked why he did it he said that a maulana told him that it was a jinn that made him sell and that he also needs money due to his wife going into retirement. He also said that he had sold the previous at a time when it could make money. He claims that he read istigaraah salaah and immediately after reading he opened he decided to open the Quraan to any page and see where it will open and it opened on a page where Allah Ta'ala says that sustenance comes from Allah so that was his answer to his istigaraah that he should go ahead and re-open his bussiness. Person B felt cheated and decided to go to the jamiat for arbitration and person A says that he spoke to a mufti and should worry because this is not a big deal and that the mufti will contact the jamiat and inform them if it was to go further. Person B went to a lawyer to represent him at arbitration,the Lawyer drafted a letter which a copy was sent to Person A and then Person A claims that he sold the new bussiness to his relative. Person A also gave the letter to the lawyer saying he sold the bussiness but Person B has continuously seen Person A at the suppliers buying goods in the same period of time that he claims he has sold the new bussiness and claims to just work for the new owners. In the period of time that the new bussiness has been open Person B has lost customers Person A as well as a loss of income where salary cannot be taken from the bussiness every month as well as not been able to replace stock as when its needed due to having to make sure rent and staff salaries are met regularly. What can Person B do in this situation? Please make me maaf for the length of question. Jazakallah.

Answer

Whether person A sold the business due to Jinn or whatever reason it is valid and he can still open another business similar in nature anywhere. Person B must firmly believe that Allaah is the sole Rabb/Provider. Have full faith, work hard, all will make money and all will be happy.

I want to invest in it but in specific areas, like construction companies, oil companies in UAE. Asked a friend of mine, she discouraged me, her theory is must Arab companies have shares either in Airline or Hotels worldwide and she said these hotels or Airlines sells haram products like alcohol, pork etc and because of that it makes their money Haram. Stock exchange trading in those things that are permissible but best to abstain because who bears the loss if it collapses.

This is lying and deceiving. This is fraud. There can be and will be no Barakaat blessing in such un-Islaamic Haraam bahaviour.

Assalamalikum. dear mufti iam from saudi arabia. my boss ask me to do job which is not mine. job is to go on site take dimention of contractor what they work like plaster.paints slab everything iam an architect. this is not mine job to calculate quantity server. my boss said he will take from contractor and give me money from his bill till now he didnt give me anything. contractor is asking me to take from him without knowing boss. iam doing company work in office time they are giving me money if i take it will be haram?

Answer

If the boss of your company asks you to do a job then he has to pay you, not someone else.

And my first question is : Can we actually hold these houses and run them on rental without selling them ? Which also mean, physically the house is still there, but the ownership is being distributed among the inherator ?? jazakallaahukhair waslm

Answer

In a house there can be many share holders. For example. 4 shareholders (owners) to a house. Rental received R20,000,00 per month. Thus each will receive R5,000,00 per month.

respected mufti sahib Our father and mother, both have passed away.They have left behind 3 houses, 2 cars and 2 lands for the 3 of use (all married working men). We have sold the cars, but we cannot manage to sell the house / land yet. All of us have got their own houses, and live in a different city where these properties are. At the moment, we rented out 2 of this houses (one house, we rented out the rooms), and keep the rental money in a separate account. This money is never distributed, but if any body need money for some urgent need, they might take the money as their wish. Some of us prefer to keep it this way, as we will have a place to gather together in the city where we were born and where our father and mother had been buried. None of us are rich enough to buy this property in cash (in order to transfer the name and keep it within the family), therefore we need to sell it to the third party. So, can we keep the management of property this away? If yes, how about the rental money, should it be distributed or keep it in one account? I myself feel worried what will happen in the future. please give some advice

Answer

Rental to be distributed as per Islaamic Inheritance share holiday. The other house will have share holding as per Islaamic Shares.

AsSalaamu Alaikum Mufti Please can you coment on the this incedent that happened. yesterday after zuhr i was in my car at a shop when a person came selling socks and knifes and wanted help, so i bought a pair of socks. later that same evening i was in a take away and the same begger came and asked me for something and to buy from him. i told him i bought from him in the morning. later when i finish and went to my car, he followed me again. i told him again very nicely that i bought from him earlier on. he replyed and said that " i did not buy from him" i got upset shouted at him and showed him the socks i bought from him then he went away. i dont ever shout at beggers, evan if i dont give anything i have never shouted or chased them away. yesterday i was not feeling well and got upset when he said i am lying. can you refer and dua or book for the prevention of anger. jazakallah.

Next time walk away. Increase recitation of Durood Sharief. Especially when angry.

For each client that one manage to canvass, one get a sum of money. The client which one has canvassed may also be entitled to the same if he also buy a certain quantity of goods. As-salaamu-alaikum Mufti Our family have a situation where we really need help.When my husband and I went for huj in 2008 we made dua and asked Allah SWT to bring us back many more times to his sacred House.Two months later my husband got a job offer to work in Saudi Arabia.My husband then planned to resign from his jobfrom SA and even though the Saudi job offered less money then what he earned in SA we felt that Allah SWT answered our dua since we wanted to be in Saudi to spend our time and ibaadah at the two harams.My husband was retrenched before he could resign and we then new that this was Allah SWT sign for us to relocate.My husband has been working there for the past 4 years and alhamdudillah he is so happy since where in the world will you an opportunity to be one Friday in Makkah and the next in Madinah.Our dilema is that we have older kids the eldest being a girl age 25 who completed her degree and now furthering her studies to become a teacher and also need to get married.My son is 19 years old and was battling with the IGSCE British curriculum and I decided to return to SA in Jan 2012 for him to complete his matric whilst my husband continued working in Saudi Arabia we then went to Saudi every school holiday and my husband also came home to us Often.My son will be taking a year of to do his Dhor since he is a hafez,after a boy child reaches 18 in Saudi they donot renew his Iqama.My youngest daughter is 16 years old and also have to do her last 2 years of schooling in SA since universities require students to have Afrikaans.My husband has resigned from his Saudi job but is very heartsore since he feels that we have a responsibilty towards the kids and the oldest has to get married and where will she get a marriage opportunity in Saudi.My kids and I feel sad as Saudi has become home for us and the thought of leaving the haram breaks our heart..Our question is are we doing the right thing?My husband has done istikhara and signed a job offer in South Africa as the feeling he got was that his decision to leave was positive.He is finding it very hard and has 2 weeks left in Saudi and his company /collegues is begging him to stay.This is weighing heavy on our family and we need advice. I'm sorry for the long story but I feel that you need to know our circumstances to be able to make an informed reply. Jazakullah Mufti may Allah SWT keep you steadfast and reward you abundantly

It is not compulsory to stay in Saudi and visit the Harams. But is is necessary to Islaamically bring up your children as good Muslims. Thus take the job in SA.
